1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the websites, platforms and services operated by House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"), including this website and all associated websites within the HALP network.

By accessing or using our websites and services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. About Our Service

HALP operates an independent property information and advertising marketplace. We:

Publish information about master planned communities, precincts, land estates and new homes
Display advertising and listings submitted by developers, builders and agents
Facilitate connections between consumers and property industry participants
Connect consumers with licensed mortgage brokers in our partner network
Publish a business directory of property industry professionals

We are not:

The developer, owner, vendor or seller of any land or home displayed on our sites
A licensed estate agent acting for you
A provider of financial, credit, legal, taxation or investment advice
A party to any contract of sale or building contract you enter into

3. Independence Disclosure

This website is an independent marketplace. It is not the official website of any developer, and it is not affiliated with, endorsed by, or operated by any government authority, council, or planning agency.

References to precinct structure plans, planning amendments, government projects and public data are provided for general information and are drawn from publicly available sources at the time of publication.

4. Information Accuracy and No Reliance

All information on our websites, including maps, plans, staging, indicative pricing, dimensions, timelines, travel times, demographics and estimated figures:

Is provided in good faith for general information only
May be sourced from third parties, including advertisers and public agencies
May change without notice
Is not a representation, warranty or offer

Figures marked "Estimated" are modelled and indicative only. They are not valuations, forecasts or guarantees of performance.

You must make your own enquiries and verify all information with the relevant developer, builder, agent, council, planning authority or professional advisor before making any decision.

5. No Financial, Legal or Investment Advice

Nothing on our websites constitutes financial product advice, credit advice, legal advice, taxation advice or investment advice. Information is general in nature and does not take into account your objectives, financial situation or needs.

Home loan and finance information is provided for general education. Credit assistance is provided by licensed third party brokers and lenders, not by HALP. Loan approval, rates, grants, concessions and eligibility criteria are set by lenders and government bodies and can change at any time.

You should obtain independent professional advice before acting on any information on our websites.

6. Property Listings and Enquiries

6.1 Third-Party Content

Listings, images, artist's impressions, floorplans, prices and availability are supplied by advertisers. HALP does not independently verify this content and is not responsible for its accuracy or completeness.

6.2 Enquiries

When you submit an enquiry about a listing, your details are passed to the relevant advertiser, who becomes responsible for handling your information under their own privacy policy. HALP does not control how advertisers use your details after that point.

6.3 Availability and Pricing

Land and home availability, pricing and promotions change frequently. Any price shown is indicative and subject to change or withdrawal without notice, and does not include all costs such as site costs, upgrades, duty and fees unless expressly stated.

7. Your Obligations

You agree to:

Provide accurate, current and complete information when using our forms and accounts
Use our services only for lawful purposes
Not misuse, interfere with or attempt to gain unauthorised access to our systems
Not scrape, harvest, copy, republish or resell our content without written permission
Not upload unlawful, misleading, defamatory or infringing content
Not use our contact details or forms to send unsolicited commercial messages
Keep your account credentials secure and notify us of any unauthorised use

8. Advertiser and Business Listing Terms

If you advertise or list a business with us, you additionally warrant that:

You hold all necessary licences, registrations and insurances for your services
All content you supply is accurate, not misleading and compliant with Australian Consumer Law and applicable real estate advertising rules
You have the rights to all images, logos and materials you supply, and grant us a licence to publish them
You will promptly notify us of changes to availability, pricing or your credentials

We may edit, decline, suspend or remove any listing at our discretion, including where content is inaccurate, unlawful or breaches these Terms. Subscription and advertising fees are payable in accordance with your agreed plan.

9. Intellectual Property

All content on our websites, including text, layout, graphics, logos, design system, data compilations and software, is owned by HALP or its licensors and is protected by Australian and international intellectual property laws.

You may view and print content for your own personal, non-commercial use. Any other use, including reproduction, adaptation, framing or commercial exploitation, requires our prior written consent.

Third-party trade marks, including those of developers, builders and government agencies, remain the property of their respective owners.

10. Data Attribution

Demographic and statistical data may be sourced from the Australian Bureau of Statistics and is used under the Creative Commons Attribution 4.0 International licence. Mapping is provided using OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database Licence.

11. Third-Party Links

Our websites contain links to third-party websites and services. We do not control and are not responsible for their content, products, services or privacy practices. Links are provided for convenience and do not imply endorsement.

12. Disclaimer of Warranties

To the maximum extent permitted by law, our services are provided "as is" and "as available". We do not warrant that:

Our websites will be uninterrupted, secure or error free
Information will be accurate, complete or current
Any property, builder, agent or broker will be suitable for your needs
Any outcome, return, growth, yield, timeline or approval will be achieved

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

13. Limitation of Liability

To the maximum extent permitted by law, HALP and its directors, employees and agents are not liable for any indirect, incidental, special, consequential or economic loss, loss of profit, loss of opportunity or loss of data arising from or in connection with your use of our websites or services, or your dealings with any advertiser, builder, developer, agent or broker.

Where liability cannot be excluded, our total liability is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

14. Indemnity

You indemnify HALP against all claims, losses, damages, costs and expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of our services, or content you submit to us.

15. Privacy

Our collection, use and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms. Please read it at /privacy-policy.html.

16. Suspension and Termination

We may suspend or terminate your access to our services at any time, with or without notice, where we reasonably believe you have breached these Terms or where required for security, legal or operational reasons. You may stop using our services at any time and may request account deletion as set out in our Privacy Policy.

17. Changes to These Terms

We may update these Terms from time to time. Changes take effect when published on this page, with the "Last Updated" date revised. Your continued use of our services after changes are published constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force.
Our failure to enforce a right does not waive that right.
These Terms constitute the entire agreement between you and HALP in relation to your use of our services.
